RUSKIN - Plans for a special-use permit to allow all-night dirt excavation and hauling from an existing borrow pit off U.S. 41 near the Manatee County line have been withdrawn.
A hearing on the permit was scheduled for Nov. 16, but the county received a letter from the attorney representing the Delaware company seeking to operate the pit that it was withdrawing its request.
The company, CL Realty LLC, was seeking the nighttime approval so it could haul dirt to Florida Department of Transportation construction projects along Interstate 275 that are being conducted at night.
The county's planning and growth management department did not support the permit request.
Biff Craine, attorney for CL Realty, said the company was not able to obtain approval for the night dirt hauling prior to the contract date and that no such jobs were being bid in 2008, so its plans were being withdrawn.
